RM Lodha and Justice Kurian Joseph Bench, while dismissing the petition of pharmaceutical companies and distributors that must be implemented within 15 days of notification . Not the current stock is sold at high prices . The petitioners demanded that the notification be applied to existing stocks to be allowed to sell at high prices .

The government told the Supreme Court that the drug price control order ( DPCO ) after notification of revised and lower prices of pharmaceuticals also apply to unsold stock . The apex court has agreed to the Centre's plea . The bench said , " It is clear from paragraph 14 of DPCO be notified immediately once the prices will apply . Unsold stocks of drug makers have been given 15 days to make proper arrangements . If the plea is accepted if manufacturers or distributors syrup used the same formula - would be to risk being sold at different prices . " Moreover , according to the Court , it may be that the manufacturer over a period of 15 days after notification by the tremendous production of drugs should sell at high prices . At this point , the Supreme Court upheld the Karnataka High Court order , the Delhi High Court's decision was flawed .
